In a HUGE ruling. A federal judge has ruled that Trump unlawfully invoked the Alien Enemies Act because there is no declared war, invasion, or predatory incursion as the law dictates there has to be. This judge was appointed by Trump himself. The judge notes in his decision that the act requires Congress to declare war, the President can’t unilaterally decide when the act can be applied. Adding that Trump ultimately does not have the legal authority to invoke the act, detain Venezuelans, transfer them within the US, or deport them. The judge also said that Trump can still deport the people he wants to deport but he has to do so under regular deportation law. If the government appeals, they will go to the 5th circuit court of appeals which is one of the most conservative courts in the country and then likely it will go to the Supreme Court. The Supreme court has already ruled on aspects of this. First finding that the court has to return Kilmar Abrego Garcia to the US after wrongfully deporting him. In a second ruling, finding that detainees must receive due process. And in a third ruling that came at 1 in the morning, they halted deportations to El Salvador from North Texas.
